§ 2-42. Group insurance authorized.

  • (a)

    The board of county commissioners of the county is hereby authorized, empowered and permitted to provide for group insurance, including life, health, accident or annuity insurance, any, or all of such insurance, for elective or elected county officials of the county, their employees, and their respective families.

    (b)

    Elective or elected county officials shall mean members of the board of county commissioners, clerk of the circuit court, the sheriff, tax assessor, tax collector, county judge, and supervisor of elections, whether serving by appointment or elected.

    (c)

    Employees shall mean all members of the road crew, the attorney to the board of county commissioners, and all other individuals regularly employed by and being paid directly from county funds by any of the elective or elected county officials.

    (d)

    The board of county commissioners of the county may elect to exercise the authority provided for in this section by a majority vote of the board of county commissioners, legally assembled and by such action being duly recorded in the minutes of said board.

    (e)

    The board of county commissioners of the county is hereby authorized and empowered to pay out of appropriate county funds all or any portion of the premium, or cost, of such group insurance and to deduct from the salaries of such elected county officials and their employees, any portion of cost for such group insurance which may be determined to be paid by such elected county officials or their employees when said elected county officials or their employees make request for such insurance and the remainder of the cost of such group insurance, if any, may be paid from county funds as herein provided and all premiums on said group insurance are to be paid or remitted directly by the board of county commissioners to the insurance company issuing or providing such group insurance.

    (f)

    All elected county officials that are on an independent budget for their respective offices are authorized to pay out of their respective budgets for themselves, their employees, and their respective families, the same portion of cost for such group insurance as is paid out of county funds for other elected officials, their employees, and their respective families. The portion of the cost of such group insurance to be paid from county funds shall be uniform when paid by the board of county commissioners or out of the respective budgets of various elective county officials, the portion to be paid by the elective officials and employees shall be determined by a majority vote of the board of county commissioners duly recorded in the minutes of said board.

    (g)

    The participation in such group insurance by any elective county official or employee as provided herein shall be entirely voluntarily at all times. Any official, member of the board of county commissioners, or employee may, upon any payday, withdraw or retire from such group insurance plan by directing the clerk to the board of county commissioners or proper official to discontinue deductions from wages in payment of such premiums.

    (h)

    To make available to the elective county officials of the county, as above enumerated, their employees, and their respective families and the same is hereby determined to be for a county purpose.
